ARTICLE 2- SUBJECT The subject of this contract is the sale and delivery of the product specified below, the basic characteristics and selling price of which the BUYER ordered electronically from the website www.boruburada.com belonging to the SELLER, in accordance with the provisions of Law No. 4077 regarding the Protection of Consumers and Law No. 6698.

ARTICLE 4- GENERAL PROVISIONS 4.1- The BUYER declares that they have read and understood the basic characteristics of the product, the selling price, payment method, and delivery information regarding the product subject to the contract on the website www.boruburada.com, and provided the necessary confirmation in the electronic environment. 4.2- The subject of the contract shall be delivered to the BUYER or the person/institution indicated at the address within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence, provided that it complies with the legal regulations. This period shall not exceed 30 days. 4.3- If the subject of the contract is to be delivered to another person/institution other than the BUYER, the SELLER shall not be held responsible if the recipient refuses to accept the delivery. 4.4- The SELLER is responsible for delivering the subject of the contract in sound, complete, and in accordance with the specified qualifications in the order, along with any warranty documents and user manuals, if any. 4.5- For the delivery of the subject of the contract, the signed copy of this contract must be delivered to the SELLER and the payment must be made by the payment method preferred by the BUYER. In case the product price is not paid for any reason or canceled in the bank records, the SELLER is relieved of the obligation to deliver the product. 4.6- If the credit card belonging to the BUYER is used unlawfully or illegally by unauthorized persons other than the BUYER after the delivery of the product, and if the bank or financial institution does not pay the product price to the SELLER, it must be sent to the SELLER within 3 days. In this case, shipping costs belong to the BUYER. 4.7- If the SELLER cannot deliver the subject of the contract within the specified time due to force majeure or extraordinary situations such as adverse weather conditions preventing transportation, the interruption of transportation, the SELLER is obliged to inform the BUYER. In this case, the BUYER may cancel the order, replace the subject of the contract with an equivalent if available, and/or delay the delivery period until the obstacle is removed. In case the BUYER cancels the order, the amount paid will be refunded to them in cash and in full within 10 days. 4.8- Defective or damaged products of the products sold with a warranty certificate or not can be sent to the SELLER for necessary repairs within the warranty conditions, and in this case, the shipping costs shall be covered by the SELLER. 4.9- This contract becomes valid after being signed by the BUYER and sent to the SELLER via fax or mail.
ARTICLE 5- RIGHT OF WITHDRAWAL The BUYER has the right of withdrawal within 7 days from the delivery of the product to themselves or to the person/institution at the indicated address. In order to exercise the right of withdrawal, it is mandatory to notify the SELLER by fax, e-mail, or phone within this period and the product must not have been used within the framework of the provisions of Article 6. It is obligatory to return the original invoice and a cargo delivery receipt showing that the product has been sent to the SELLER within 7 days following the receipt of these documents. The product price shall be refunded to the BUYER within this period. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded. The shipping cost of the returned product due to the right of withdrawal is covered by the SELLER.
ARTICLE 6- COMPETENT COURT In the application of this contract, Consumer Arbitration Committees and Consumer Courts located at the place of residence of the BUYER or the SELLER, up to the value declared by the Ministry of Industry and Commerce, are authorized. In case the order is placed, the BUYER is deemed to have accepted all the terms of this contract. SELLER www.boruburada.com
